Terms of Service for Metrika

Welcome to Metrika (“Metrika”, “we”, “us”, or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Metrika API, website, and related services (collectively, the “Service”).
By creating an account, accessing the API, or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a legally binding agreement to use the Service.
By using the Service, you represent and warrant that you meet these requirements.
2. The Service
Metrika provides access to social media metrics through a REST API.
The Service may include:
- API access
- Authentication tokens
- Rate-limited metric retrieval
- Usage dashboards
- Documentation and related developer tools
We may modify, suspend, or discontinue any part of the Service at any time.
3. Accounts
To use the Service, you may be required to create an account.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities performed under your account
- Ensuring your information remains accurate and up to date
You must notify us immediately if you believe your account has been compromised.
4. API Tokens
API tokens are used to authenticate requests to the Service.
You are responsible for:
- Keeping API tokens secure
- Preventing unauthorized access to your tokens
- Revoking compromised tokens immediately
You must not:
- Share tokens publicly
- Embed tokens in client-side code exposed to end users
- Attempt to bypass authentication or rate limits
We may revoke tokens that compromise the security or integrity of the Service.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to interfere with or disrupt the Service
- Reverse engineer or attempt to extract source code from the Service
- Circumvent rate limits or access controls
- Use automated methods to abuse or overload the infrastructure
- Resell or sublicense access to the Service without authorization
- Use the Service in a way that violates third-party rights or platform terms
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Third-Party Platforms
Metrika retrieves and processes information from third-party platforms.
We are not affiliated with, endorsed by, or sponsored by any social media platform unless explicitly stated.
We do not guarantee:
- Availability of third-party platforms
- Accuracy of third-party data
- Continued compatibility with external services
- Availability of any specific metric
Third-party platforms may change their systems, policies, or availability at any time.
7. Rate Limits and Availability
Access to the Service may be subject to rate limits, quotas, and operational restrictions.
We may throttle, limit, or suspend access to protect the reliability and security of the Service.
We do not guarantee uninterrupted or error-free operation.
8. Fees and Billing
Some parts of the Service may require a paid subscription.
Payments are processed by Stripe.
By purchasing a subscription, you authorize recurring billing for the selected subscription plan until canceled.
Unless otherwise required by law:
- Fees are non-refundable
- Subscriptions renew automatically
- You are responsible for applicable taxes
You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.
9. Intellectual Property
The Service, including software, branding, documentation, and related materials, is owned by Metrika and protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service.
You may not:
- Copy or redistribute the Service except as permitted
- Remove proprietary notices
- Use our branding without permission
10. Feedback
If you provide feedback, suggestions, or ideas regarding the Service, you grant us the right to use them without restriction or compensation.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, METRIKA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- AVAILABILITY
- ACCURACY OF DATA
We do not guarantee that the Service will always be secure, uninterrupted, or error-free.
The Service is provided in beta form. Metrics may be delayed, incomplete, or temporarily unavailable as we maintain and stabilize our data collection systems. Third-party platforms may change their systems or policies at any time, which may affect metric availability or accuracy.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, METRIKA SHALL NOT BE LIABLE FOR:
- INDIRECT DAMAGES
- INCIDENTAL DAMAGES
- CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS
- LOSS OF DATA
- BUSINESS INTERRUPTION
Our total liability arising out of or relating to the Service shall not exceed the amount paid by you to Metrika during the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Metrika, its operators, affiliates, and service providers from claims, damages, liabilities, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of applicable laws or third-party rights
14. Termination
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms
- Your use poses security or legal risks
- We are required to do so by law
You may stop using the Service at any time.
Sections that by their nature should survive termination will survive termination, including limitation of liability and indemnification provisions.
15. Privacy
Your use of the Service is also governed by our Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time.
When changes are made, we will update the "Last updated" date above.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Portugal.
